Already in September, small-scale privatization auctions will return in Ukraine. The corresponding draft law No. 7451, which simplifies and speeds up this procedure during martial law, was adopted by the Verkhovna Rada on July 28.

Following the representatives of the Ministry of Economy, according to the schedule, auctions for distilleries and bakeries will be announced first. This will support and expand the agricultural sector.

What Will Change in Auctions for Small-Scale Privatization Objects in Prozorro.Sale?

According to draft Law No. 7451 (hereinafter referred to as the Law), auctions for the sale of small-scale privatization objects will continue to be held in the Prozorro Sale system. Auctions, information announcements of which will be made public before the Law takes effect, will become available on the day after the Law comes into force.

Bidding will be held according to the old rules, but with certain changes that will be in effect until the end of martial law and the development of relevant technical changes, in particular:

1. The phasing will change: after all, parties sign the protocol, the privatization body will conclude a sale and purchase agreement with the winner only after he pays the sale price of the lot.
2. Provide for the possibility of holding a fourth auction (Dutch) for the same object, if the third does not take place due to the disqualification of the winner.
3. If three auctions have already been held for the sale of the privatization object and the winner was disqualified in each of them, the amount of the guarantee fee for such a lot increases. This rule also applies to small-scale privatization objects published in the system before the entry into force of the Law.
4. Bidding fees will be charged on the guarantee fee. The system will return the difference to the participant after the end of the auction, and the winner will be credited to the sale price of the lot.
5. Allows signing protocols with the QES, except when the winner insists on a different form.
6. The time between the first and second auctions will be shortened.

Relevant changes are implemented in the Prozorro.Sale system after the entry into force of the Law. After that, for the duration of martial law, for bidding for small-scale privatization objects, reduced exposure periods for the first and repeated auctions will apply.

What Will Change for Objects of Large Privatization?

Objects of large privatization, the book value of which is more than UAH 250 million, during the martial law will be put up for auction in the Prozorro.Sale electronic system as soon as the relevant rules come into force.
