On May 24, the Cabinet of Ministers of Ukraine adopted Resolution No. 617, which amends the Resolution of the Cabinet of Ministers of Ukraine No. 300 dated March 17, 2022, on ensuring the uninterrupted functioning of the system for providing electronic trust services. One of the main changes is that the use of AES (advanced electronic signatures) is allowed for the duration of martial law on the territory of Ukraine and another six months from the moment it is canceled or terminated.

What Does the Change Mean for Procurement Participants?

Business representatives will be able to use the choice of QES or AES in their work until the end of martial law and for another 6 months from the date of its cancellation/termination in Ukraine.

But to participate in public procurement, suppliers will need exactly the type of electronic signature that the customer specifies in the terms of the tender documentation. If a QES is specified in the documentation conditions, only it can be used, but if the type of signature is not specified, it is allowed to use a QES or AES of your choice.
