The Ministry of Economy has proposed amending Resolution No. 169 aimed at bringing back competition in public procurement. This will help customers save more money on the purchase of goods, works and services, and business – more often and easier to find potentially interesting orders.

What Changes Are Proposed to Be Made to the Resolution?

The Ministry of Economy proposes to make the following changes to the procurement procedure under martial law:

1. To purchase goods, works, or services in the amount of UAH 50,000 or more, customers must use simplified procurement or Prozorro Market. The upper limit of the amount is not defined. We remind you that now you can also buy services in the e-catalog.

2. Such purchases can be carried out without the use of a marketplace or simplified purchases if:

- - procurement information must not be disclosed because it has limited access or its disclosure in wartime may threaten national security;
  - the organizer at the time of the decision to conduct the purchase is located in the territory where active hostilities are taking place;
  - the customer does not have the technical ability to use the electronic procurement system;
  - it is important to make the purchase as soon as possible and there are objective circumstances that do not allow for compliance with the terms provided for by law.

3. It is allowed to purchase goods, services, or works exclusively from one supplier if:

- - there is no competition for technical reasons;
  - the customer purchases supplies of electricity or natural gas;
  - the simplified procurement was canceled because no bidder submitted a proposal;
  - the organizer must purchase additional similar services or works from the same supplier;
  - the purchase is made to maintain the functioning of critical infrastructure facilities.

We are waiting for the adoption of amendments to Resolution No. 169 by the Cabinet of Ministers of Ukraine and the restoration of competitive bidding in the electronic system. This will help many suppliers to return to participation in public procurement, and customers to spend less money and save the budget on other important goods, works, and services.
