On October 19, 2022, draft law No. 7636 (hereinafter referred to as the Draft Law) was adopted, which amends certain legislative acts with the aim of resuming procedures for the lease of agricultural land plots. Thus, in Ukraine, the mechanisms of state registration of lease rights on agricultural land plots, which were in effect before the beginning of martial law, are again being launched.

Land Auctions for Leases Will Return to Prozorro.Sale

Since the introduction of martial law in Ukraine, the leasing of land through the electronic system has been suspended – the Land Code contained regulations prohibiting auctions regarding lease rights, superficies, and emphyteusis of agricultural lands that are in state and communal ownership. The Draft Law cancels these norms, which will allow the resumption of auctions for the lease of plots on Prozorro Sale.

Thus, as soon as the Draft Law enters into force, the relevant auctions for agricultural lands, which are in state and communal ownership, will appear in the electronic trading system. This will allow communities to fill their budgets faster, which is especially important now when funds are constantly needed for the purchase of essential goods and repairs.

What Other Changes Does the Draft Law Make?

The norms of the Draft Law also provide for the improvement of the procedure for maintaining the State Land Registry, strengthening of state supervision over the disposal of plots, as well as protection and regulation of the use of funds for land protection.

At the same time, the sale of plots of agricultural land designated as a state and communal property is currently prohibited.
