The Cabinet of Ministers made changes to Resolution No. 1178, which regulates the rules for conducting public tenders during martial law. According to them, from January 3, open tenders with special features will be temporarily held without the auction stage.

What Did Cause Such a Change?

Currently, power outages continue in Ukraine, and another shelling from the Russian Federation may cause a long-term lack of light and communication. Similar situations already led to the fact that suppliers lost the chance to win due to the inability to be present at the auction or asked to postpone the bidding in the Prozorro system to another day.

So the government decided to minimize the risks and ensure equal chances for all participants by temporarily canceling the auction stage. As soon as the situation in Ukraine stabilizes, open trades with special features will again begin to be conducted according to the usual algorithm.

What Does It Mean for Suppliers?

Suppliers participating in the open bidding process with features announced from 3 January should note that once they have submitted their proposal, they will automatically enter the evaluation stage. There will not be a three-round auction stage, during which they can see the offers of other participants and offer a better price.

The sequence in which the customer will evaluate the offers of the participants will be determined by the amount of their price offer. Thus, the supplier who offered the best price will be considered first. If the customer decides to reject them, the next most profitable offer will be considered. The one whose price turned out to be the highest will be considered last. Such a rule should compensate for the absence of an auction and encourage business representatives to immediately offer a price at which they are ready to conclude an agreement with the customer.

What Does It Mean for Government Customers?

Customers who will announce open tenders with special features from January 3 should adjust the text of the tender documentation, if it contains information about the auction stage, by the current legislation.

It is also necessary to remember that in case of a temporary absence of the auction stage, the purchase will take a little less time.
