Defense Procurement

On April 23, the new rules from the updated Law of Ukraine "On Defense Procurement" came into effect. From now on, organizers of such procurement are required to indicate unit prices and other important information in their non-armed procurement. The relevant functionality has already been implemented in the electronic system.

What Has Changed?

Designated government customers are required to provide reports on their non-armed procurement (such as food, clothing, fuel, etc.) if their cost exceeds the established threshold values:

- UAH 200,000 – in the case of purchases of goods and services;
- UAH 1.5 million – in the case of the purchase of works.

Only the minimum necessary information must be included in the reports:

- customer's name;
- procurement subject;
- unit price.

However, the organizers are not obliged to disclose details regarding the total amount, the volume of purchases, delivery locations, and the name of the supplier. An appropriate level of data publication has been ensured in the electronic system, sufficient to allow for price analysis.

Additional Conditions for Customers of Purchases Catering Services

In such a case, the organizers must upload to Prozorro the price data per unit of each item. The information is submitted as a calculation file.

What Is the Reporting Deadline?

As a reminder, customers must now comply with the following reporting requirements:

1. Publish reports in the electronic system within 10 business days from the date of contract signing – for all agreements concluded from April 23 onwards.
2. Provide a report for all contracts concluded between February 24, 2022, and April 23, 2023, by June 22, 2023.
