Since April 16, the next set of criteria will be electronically introduced in the Prozorro system. This time, these will be criteria that may relate not only to the tender (in non-lot procedures) but also to each lot (in single- and multi-lot procedures):

1. Securing a tender proposal.
2. Securing the procurement contract.

At the stage of accepting bids, all suppliers will tick the appropriate check-boxes to confirm the provision of the tender proposal. Confirmation of securing the execution of the procurement contract is provided only by the winner after the end of the auction.

More About Criteria

For the organizer, the tender security is a guarantee that the participant will adhere to his obligations and will not refuse to sign and fulfill the contract in the future. Read more about this here.

The Law "On Public Procurement" provides for two ways to confirm the tender security:

1. Securing a tender proposal – providing a participant with a guarantee of fulfillment of obligations to the customer arising from the submission of a tender proposal.

2. Securing the procurement contract – provision by the winning bidder of security for fulfillment of obligations under the procurement contract. The customer may require to provide security for the performance of the contract in the form of a guarantee, deposit, surety, etc.

Tender collateral is used in simplified procurement procedures, open tendering (including publication in English), and energy service procurement procedures (ESCO).

How do customers work with the new criteria format?

The customer who wants to add the criterion "Securing a tender proposal" shall fills in when creating/adjusting the purchase in the section "Securing a tender proposal" in the conditions:

1. Select a document pre-loaded for purchase – here you can upload a guarantee form (for example, if the customer provides it as part of the tender documentation). The guarantee form file must be uploaded to the system with the type "Eligibility Criteria". Optional field.
2. The amount of collateral – required field, in which you must specify:

- - up to 0.5% of the expected purchase price – if works are purchased;
  - up to 3% of the expected purchase price – if goods or services are purchased.

3. Currency – required field. The currency of the bid security must be the same as the currency of the expected purchase price.

4. A full description of the conditions, type, and amount of the provision of collateral – required field, information from which will subsequently be displayed in the printed form of the announcement. Therefore, it is important to fill it out carefully.

The customer who wants to add the criterion "Securing the procurement contract" shall fills in when creating/adjusting the purchase in the section "Securing the procurement contract" in the conditions:

1. Select a document pre-loaded for purchase – here you can upload a document template. The guarantee form file must be uploaded to the system with the type "Eligibility Criteria". Optional field.
2. A full description of the conditions, type, and amount of the provision of collateral – required field, information from which will subsequently be displayed in the printed form of the announcement. Therefore, it is important to fill it out carefully.

How Can a Supplier Provide Tender Security?

When submitting a tender proposal, the supplier fills in the appropriate fields:

1. Title – optional.
2. Description – optional.
3. Select a document pre-loaded for purchase – when uploading documents to confirm the placement of an order, you must select the file type "Documents confirming compliance".

How Can a Supplier Provide Contract Performance Security?

At the stage of submitting proposals, each participant confirms their agreement to provide security for the execution of the contract by ticking the appropriate box.

When the purchase is in the “Proposals reviewed” status, the winning participant provides security for the execution of the contract in the form of a document that the customer requires (a file with a guarantee, a payment order, etc.). The supplier also completes the following fields:

1. Title – optional.
2. Description – optional.
3. Select a document pre-loaded for purchase – when uploading documents, you must select the file type "Ensuring the implementation of the contract".
