At the beginning of April, Prozorro.Sale realized the possibility of holding some types of auctions in just 2 days. This change will be in effect until the abolition of the legal regime of martial law in Ukraine.

What Auctions Does This Apply to?

With the "fast" auctions, the organizer will be able to sell and lease commercial property and assets, the sale of which is carried out under the ETS Regulations. The new conditions will not apply to auctions regulated by the laws and regulations of the Cabinet of Ministers of Ukraine, in particular, to land sales or small-scale privatization.

At its own request, the organizer can hold an auction according to a simplified scheme (for 2 days) or according to the usual one, in which the submission period lasts 30-45 days. All auctions announced before April 4 will be held as scheduled.

How to Conduct "Fast" Auctions During the War?

Under the new conditions, the organizer publishes an announcement a maximum of 2 calendar days before the date of the auction. They indicate information about the lot, the amount of the guarantee fee and a list of documents required for participation. The protocol of the auction and the contract can be signed or not be signed with a qualified electronic signature - the organizer makes the decision on the need for this action at their own discretion and informs about it in the conditions of the announcement.

The organizer concludes a deal with the winner based on the results of the auction. This must happen within 3 working days from the day following the day the protocol was formed in the ETS, provided that the organizer provided for the signing of the contract and did not determine a longer period for this.

Who Wins in "Fast" Bidding?

During the auction of three rounds, the participants who submitted their proposals raise their bids one by one. The person with the highest bid at the end of the third round is the winner. If, after checking, the winner is disqualified, the proposal of the next participant is considered.
