Is It Allowed to Buy in the Catalog While the Martial Law in Ukraine?

According to the CPO, the addition of services to the e-catalog became possible thanks to Resolution No. 169 (hereinafter referred to as the Resolution), adopted in February. Paragraph 1 establishes that public and defense procurements are carried out without the use of procurement procedures (including simplified ones) determined by the relevant Laws of Ukraine. It follows from this that the state customer can buy goods, services, and works in any way within the framework of the current legislation. This means that you can use the Prozorro Market catalog to purchase goods and services.

The Decree regulates the principles that contracting authorities for public and defense procurement must follow:

- efficient and effective spending of budgetary funds;
- carry out purchases on time and follow the decisions made to meet the needs of defense and security, as well as to protect the national interests of Ukraine.

It may be noted point 3 of the Decree proclaims the following: “Such purchases are not included in the annual purchase plan. Based on the results of their implementation in the electronic procurement system, the customer, no later than 20 days from the date of termination or cancellation of martial law in Ukraine or its areas, publishes a report on the procurement agreement concluded without the use of the electronic procurement system, as well as the purchase agreement and all annexes to it".
