Prozorro Has Added the Ability to Quickly Make Purchases for the Needs of the Ukrainian Liberation War

A refinement has been implemented in the Prozorro system to help government customers procure quickly in wartime. Relevant amendments to the legislation were expected for its launch, and today they were introduced by Resolution № 169.

Resolution of February 28, 2022, № 169 established that in martial law:

1. 1. Defense and public procurement of goods, works, and services are carried out without the use of procurement and simplified procurement procedures defined by the Laws of Ukraine "On Public Procurement" and "On Defense Procurement".
   2. Lists and volumes of purchases of goods, works, and services are determined:

• • • to meet the needs of the security and defense sector, as well as other goods, works, and services to ensure the security and defense needs of Ukraine – the decision of state customers in the field of defense;
    • for other procurements – by the decision of the state property management body of the business entity of the public sector of the economy;

     3. According to the Law of Ukraine "On Public Procurement", customers must comply with the principles of public procurement and ensure the publication of the contract in the electronic procurement system within five working days after signing. This period is extended for the period of improper functioning of the electronic procurement system, confirmed by its administrator. A contract that is not published in the electronic procurement system within the prescribed period is void.

How to Purchase in Wartime?

When reporting on a concluded contract of the “Purchase without using an electronic system” procedure type, it became possible to select the sign “Ukrainian Liberation War”.

Linking to the plan is optional and is used if necessary by the customer. The procedure for publishing purchases does not change.
