On June 9, the Law of Ukraine No. 2247-IX came into force, aimed at regulating land relations during martial law in the country. The introduced changes will affect the procedure for the sale and lease of agricultural land.

What Will Change in the Procedure for the Sale and Lease of Land?

During martial law, the work of the State Geocadastre in Ukraine will be suspended. Accordingly, at present, there will be no sale and lease of agricultural land that is communal or state property. The only exceptions are those plots that are leased without auctions, in accordance with the norms of the Land Code of Ukraine, in force during martial law.

At the same time, auctions for the sale of agricultural land, formed in Prozorro.Sale before the announcement of martial law may take place. But it is possible to conclude contracts and close deals on such auctions only after the resumption of the work of the geocadastre.

Also, Law No. 2247-IX supplemented the list of plots that can be leased without announcing an auction.

What Types of Plots Are Allowed to Be Leased Without Bidding?

In addition to plots of communal and state property, which could be leased before the war without announcing trades, the following lands were added to the list:

- sites intended for the location of the production facilities of enterprises relocated from hazardous territories;
- plots intended for the location of river terminals (ports), if their construction or expansion has been approved by the central executive authority;
- sites intended for the construction of utility networks for the supply of electricity, gas, water, heat, electronic communications, the laying of sewer networks, and the construction of objects of main gas pipelines.

What Land Plots Are Allowed to Be Sold and Leased in Prozorro.Sale?

State and communal land that does not have an agricultural purpose and does not fall under the purposes described in the previous paragraph can continue to be sold or leased through auctions in the Prozorro Sale system.

No restrictions are imposed on private property plots – they can be freely leased or sold, regardless of their purpose.
