On August 7, the changes made by the CPO of the State Institution "Professional Procurement" to the announcement of the selection of participants in the electronic catalog came into force. They provide for increased responsibility of suppliers for such actions:

1. Implementation of violations that contradict the rules of good practice in the e-catalog.
2. Displaying a product that does not meet the conditions of the ad.

Responsibility for Violation of the Terms of Good Practice in the E-catalog

Such violations include the following cases:

1. If the supplier made significant changes to the terms of his offer at the stage of concluding a purchase agreement. For example:

- - offered another product;
  - increased or decreased the total price and/or per unit of goods;
  - made changes to the date or place of delivery, etc.

2. If during one quotation request procedure the supplier has sent more than two price proposals.

3. If, in response to the request for quotation, the supplier offered a product that has other characteristics and does not meet the customer's requirements.

If CPO SI "Professional Procurement" receives a complaint from a customer, another supplier, or independently finds cases of violation, such proposals will be checked. In case of confirmation of the fact of violation, an appropriate protocol will be generated, which will be reported to the supplier.

If the supplier makes 3 such violations within 30 calendar days, he will be restricted from accessing the catalog for 90 calendar days.

Prohibition of Displaying Goods that Do Not Meet the Conditions of the Ad

The administrator also forbade the product to be shown in the catalog, which does not meet the conditions of the ad. That is, if a product that a supplier wants to add to Prozorro Market has characteristics that do not correspond to reality, it will not be added to the catalog or removed from it. A ban will also be imposed on the display of such an item.

What to Do if You Disagree with the Changes?

If you refuse to work in the directory according to the changed rules, you can withdraw your qualification proposal within 10 working days from the date of publication of the changes in the ad.

If you agree, you do not need to provide any additional documents.

Why Were the Ad Changes Made?

According to representatives of the CPO, recently they began to receive complaints from customers who are faced with unfair actions of suppliers: after placing an order, sellers change the price or goods or offer goods that do not meet the terms of purchase. All this undermines the level of trust in the e-catalog as a reliable way of quick purchases and therefore demotivates customers to buy goods with it.

Recall that by clause 26 of the Resolution of the Cabinet of Ministers of Ukraine No. 822 "On Approval of the Procedure for the Formation and Use of an Electronic Catalog" dated 09/14/2020, CPO SI "Professional Procurement", which is the administrator of Prozorro Market, has the right to amend all announcements on the selection of participants to the electronic catalog. So, to regulate the terms of cooperation between customers and suppliers, such changes were made.
