Yesterday, the main topic for discussion in the field of public procurement was the Order of the Prozorro State Enterprise No. 10 of 03/19/2019 "On approving the Instruction on the procedure for using an electronic procurement system when conducting procurement, the cost of which is lower in cost, established in paragraph 2 and 3 of part 1 of article 2 Law of Ukraine "On public procurement."

Together with the Order, the state enterprise published a special “Instruction on the procedure for using an electronic procurement system when conducting procurement, the cost of which is less than the cost set in paragraphs two and three of part one of article 2 of the Law of Ukraine “On public procurement.” for yourself from this news, as well as how it will affect all of us in the future.

What has changed in the system

Already today, while most of us still understood yesterday's news, Prozorro SE published another document – Order No. 11 of 03/20/2019 "On Amendments to the Instruction on the procedure for using an electronic procurement system when conducting procurements that cost less than established in paragraphs 2 and 3 of part 1 of article 2 of the Law of Ukraine "On public procurement."

Even a brief analysis of both documents makes it clear that today's Order selectively canceled certain provisions of yesterday's Order. However, some major changes did take place:

First, the Order of the State Enterprise “Vneshtorgizdat of Ukraine” dated April 13, 2016, No. 35 “On Approval of the Procedure for Sub-threshold Procurement” became invalid.
Secondly, the Order of the Prozorro State Enterprise No. 49 dated June 20, 2017 “On Amending the Procedure for Sub-threshold Procurement” also became history.

So, from now on, when preparing the pre-threshold procurement documentation, it will be necessary to refer to new Orders, otherwise, this could theoretically become a ground for appealing the implementation of the procedures. The wording applied in the approved Instruction has become less categorical in comparison with the Order of the “Vneshtorgizdat of Ukraine” dated April 13, 2016 No. 35, and the Instruction itself can simplify life for people who make pre-threshold purchases.
