It is much easier to participate in public procurement when you know all possible mistakes and skillfully avoid them. We are sharing with you a list of mistakes that were most often made by public procurement participants recently.

Incorrectly Specified File Type

When submitting a tender proposal in an open tender with publication in English, the participants incorrectly select the file type while uploading it to the system. For example, they assign the type "Price offer" or "Estimate" to those documents that are to be opened at the prequalification stage and based on which the customer must decide on the admission of the participant to the procurement.

We would like to remind you that documents marked as "Price offer" or "Estimate" are opened to the customer only after the auction. Choose the type you want carefully at boot time.

Assigning Confidentiality to the Wrong Documents

Another common mistake of procurement participants is the assignment of the “Confidential” label to those files that should be open. Most often these are documents that contain the following data:

- information about the offered price;
- confirmation of the supplier's compliance with the qualification criteria under the Art. 16 and the requirements set out in Art. 17 of the Law "On Public Procurement".

Check carefully which documents you provide the “Confidential” stamp. Remember that “just in case” labeling can cost you a bid winning.

Errors in the Appeal Procedure

Sometimes the requirements specified by the customer in the terms of the tender documents are discriminatory. In such cases, another common vendor error occurs:

1. The participant does not appeal against the discriminatory conditions of the purchase and does not demand that they be eliminated within the specified period. He simply submits his proposal and waits for the proposal consideration stage.
2. The customer disqualifies the participant due to the non-compliance of the tender proposal with the purchase conditions.
3. The participant unsuccessfully tries to appeal to the AMCU the decision of the customer on disqualification.

We remind you that you always have the right, at the clarification stage, to file a complaint or request to eliminate inconsistencies in the procurement conditions. In return, the customer is obliged to provide explanations or eliminate discriminatory requirements. Otherwise, the tender will not take place.
