Errors Not Covered By the 24-hour Rule

Even though in public procurement there is an opportunity to use the rule "24 hours to correct errors", there are certain cases that it does not apply to – inconsistency in technical documentation. For example, when the customer announced a tender for the purchase of high-rise works, and the participating company does not have a license to do so. Or when the customer indicated the characteristics of the product in the tender documentation, and the participant proposed an analog, the characteristics of which are better, but do not correspond to the specified parameters. Both cases will result in 100% disqualification.

The Bank Guarantee Does Not Comply with the Order of the Ministry of Economy

An incorrectly issued bank guarantee is still a common mistake. Recall that to secure its tender proposal, the procurement participant must provide a bank guarantee drawn up by the Order of the Ministry of Economic Development, Trade and Agriculture dated December 14, 2020, No. 2628 "On approval of the form and requirements for securing a tender proposal / proposal". If the text of this document does not contain the mailing address of the contact person, the address of the guarantor to which the documents are drawn up, the SWIFT address of the guarantor, etc., the bank guarantee is considered invalid.

Signed Files Loaded Incorrectly

Customers can demand to sign an electronic signature not only for the tender proposal but also for each of its separate documents. Such functionality is implemented on SmartTender.biz: the tool for imposing QES/AES when signing a file, for example, with the extension “.pdf”, creates its duplicate with the extension “.pdf.p7s”. According to the rules, the tender proposal must contain both ".pdf" and ".pdf.p7s", otherwise the customer will not be able to check the participant's documents. However, some participants think that ".pdf.p7s" is already a signed document and delete the ".pdf" file, which will result in 100% disqualification.
