Since February 1, a new tool has appeared in Prozorro Market – a price quotations request. And already in the first working week of February, 200 purchases were announced using this procedure. Half of them are for amounts less than UAH 50,000. Government customers have a high need to purchase a large number of different items of goods related to the same CPV code. True, making many requests for such purchases is inconvenient and takes too much time. But did you know that in situations like this you have a convenient alternative? How Can You Buy Goods in the Prozorro Market?

According to the Law of Ukraine "On Public Procurement" (hereinafter – the Law), a state customer may not declare a simplified procurement if he plans to use the marketplace to purchase goods for an amount equal to or more than UAH 50,000 and less than the amount specified in paragraphs 1 and 2 of the part 1 of the article 3 of the Law. At the same time, the Law does not determine whether a purchase in the catalog should be carried out with or without a quotation request.

By the Procedure for using the electronic catalog, a customer who wants to purchase goods in the catalog must act as follows:

1. If the cost of the goods is less than UAH 50,000, the customer chooses the seller's offer in the e-catalog and places an order.
2. If the cost of the goods is from UAH 50,000 to the amount established by p. 1 and 2 of part 1 of the article 3 of the Law – the customer publishes a quotation request, and the system automatically selects the winner with the lowest price. You can learn more about this procedure here.

The indicated amounts are the purchase price for one CPV code, which may include several items of goods. Therefore, if the purchase is from UAH 50,000 to the specified in p. 1 and 2 of part 1 of the article 3 of the Law there is a product whose price is less than UAH 50,000 – you can purchase it in the catalog directly, without using a request for quotation.

Let us explain with an example.

An Example of the Purchase of Goods Worth Up to UAH 200,000

Let's say a customer wants to buy food for UAH 190,000 within the category 03220000-9 "Vegetables, fruits, and nuts". This amount is less than the statutory amount, and therefore you can declare a simplified purchase or use an electronic catalog. The customer needs goods for the following amounts:

- potatoes – 100,000 UAH;
- carrots – UAH 30,000;
- cabbage – UAH 20,000;
- onions – UAH 20,000;
- cucumbers – UAH 12,000;
- tomatoes – UAH 8,000.

With the advent of the quotation request procedure, customers began to announce a request for each individual product. But they can act more conveniently:

1. If all products are present in the Prozorro Market

Of the entire list, only the price of potatoes exceeds UAH 50,000, and therefore only the customer is obliged to purchase it using the quotation request. The rest of the products can be bought in Prozorro Market by direct purchase, as in any online store.

Thus, at will, the customer can conclude two agreements:

1. The first is based on the results of the quotation request procedure (for the purchase of potatoes).
2. The second is based on the results of direct purchases of other goods in the marketplace – provided that they were purchased from one seller. If goods are purchased from different suppliers, a separate agreement is concluded for each purchase.

2. If some product was not in the catalog

Suppose that the customer from our example found only a part of the required products in the catalog. Then, to purchase goods that could not be found, he will have to carry out a simplified purchase, regardless of the cost of these goods.

For example, the customer did not find the cabbage. In this case, he buys everything except it in Prozorro Market and announces in Prozorro a simplified purchase worth UAH 20,000 for the purchase of cabbage.

How to Mark Such Purchases in the Plan?

If you make direct purchases through Prozorro Market, then linking to the plan is not technically necessary. You can indicate in the notes to the plan “Purchase through Prozorro Market” and indicate the type of procedure “Purchase without using an electronic system”.

If you purchase goods through a simplified procedure or a quotations request, you must link the purchase to a plan indicating the appropriate type of procedure.
