Medical procurement is one of the most important items of government spending and ranks second in terms of government spending. Every tenth tender in Prozorro concerns medicines, medical supplies or equipment. The health of the population depends on the result of such tenders, so the state is constantly trying to make medical procurement easier and faster. For example, since 2020, the centralized procurement of high-quality medicines and medical products has been carried out by the State Enterprise "Medical Procurement of Ukraine" – it operates on 14 out of 38 types of state programs of the Ministry of Health of Ukraine. Also in 2020, it was allowed to carry out procurement of funds to combat the consequences of COVID-19 under a simplified scheme to speed up procedures, and only recently they were returned to the category of regular medical procurement.

To be able to sell medicines to the state, it is important for the supplier to know the “rules of the game” on the market: to have the necessary documents, be able to correctly classify their goods and work for Prozorro. We will talk about all this in the article.

What Are the Requirements for Medicines?

A pharmaceutical product that a supplier offers to purchase a state customer must meet the following criteria:

- be registered in Ukraine;
- be registered in the country of origin;
- have a confirmed quality and a corresponding certificate;
- have instructions in Ukrainian;
- have a shelf life of at least 75% of the shelf life indicated on the package.

The supplier must document all this by providing the appropriate certificates and licenses as part of the tender proposal. The exact list of documents is indicated in the terms of the tender documents.

How Is the Subject of Procurement of Medicines Determined?

The subject of procurement of medicines is determined by the indicator of the third digit of the state classifier DK 021:2015, indicating the INN (international non-proprietary name) of this product in brackets. If we are talking about two or more drugs, then the name is prescribed for each. Usually the INN is indicated in Ukrainian, but in tenders with publication in English, it is necessary to additionally indicate the English name.

What Procedures Are Used to Purchase the Medicines?

The purchase of medicines can be carried out in one of the following ways:

- on pre-threshold purchases (up to UAH 50,000);
- on simplified procurement (from UAH 50,000 up to the established by the Law "On Public Procurement");
- by conducting above-threshold tenders (including open tenders with publication in English);
- in the Prozorro Market electronic catalogs.

Depending on the type of procedure in which the supplier participates, his algorithm of actions will also differ.

How to Sell Medicines Through Pre-threshold or Simplified Procurement?

Pre-threshold and simplified purchases announced in the electronic system follow a similar algorithm and contain the following stages:

- purchase announcements;
- clarification period;
- submission of applications for participation;
- auction;
- qualification stage – consideration of the proposal of the participant who offered the lowest price;
- selection of the winner.

The main difference between pre-threshold and simplified procurement is that for the first one the customer is not obliged to conduct a tender procedure, but can only publish a report on the conclusion of the contract in Prozorro. How to Sell Medicines Through Under-threshold Procurement?

There are purchases, the cost of which exceeds UAH 200,000. The most common way of purchasing medicines is through open tenders. They run according to the following algorithm:

- tender announcements;
- submission of applications for participation;
- auction;
- qualification stage – consideration of the proposal of the participant who offered the lowest price;
- selection of the winner.

If the customer purchases goods worth more than EUR 133,000, he must conduct an open tender procedure with publication in English. It differs primarily in that it has a prequalification stage preceding the auction stage. On it, the organizer checks all submitted applications of the participants for compliance with the established technical requirements and admits to trading only those who fit them.

In certain cases, a negotiation procedure can be used for the procurement of medicines. For example, when the tender was canceled twice due to insufficient number of participants. In this case, the purchase takes place with the participation of one supplier, and it is with him that the contract is concluded.

How to Sell Medicines in the Prozorro Market Catalogs?

Since 2020, state customers can buy medicines in the Prozorro Market electronic catalogs, for the following amounts:

1. From UAH 1 to UAH 50,000 – by making a direct purchase in the catalog (the procedure is similar to purchasing goods in a regular online store). In this case, the supplier simply processes the application and delivers the goods.
2. Up to UAH 200,000 – by announcing a request for price proposals. In this case, the suppliers send their quote in response to the customer's request. Read more about the procedure in the article.

To sell pharmaceutical products in the marketplace catalog, the supplier needs to perform a few steps:

- qualify to the catalog – it`s category are administered by the Centralized Purchasing Organization of the State Enterprise "Medical Procurement of Ukraine";
- place your goods on the "showcase" of the state online store;
- wait for the order from the state buyer and fulfill it in good faith.
