For more than 2 years, Prozorro Market has been enabling government customers to purchase goods worth up to UAH 200,000. But until now, users of our site have questions about the rules for working with the catalog, in particular with the procedure for price proposals request. 1. Does the supplier have the right to refuse to sign a direct agreement in the catalog?

The supplier has the right to opt-out, but I do not recommend doing so without good reason, as doing so would be considered a violation. The customer has the right to file a complaint with the catalog administrator against a supplier who refused to conclude a contract on the terms specified in the offer in Prozorro Market.

2. For what violations can the supplier be temporarily denied access to the catalog?

A participants may be temporarily denied access to the electronic catalog if commit the following violations:

- indicate incorrect contacts in the ad;
- indicate the price of goods in the catalog, which does not correspond to reality indicate in the catalog a description of the product that does not correspond to its actual characteristics;
- do not adhere to the deadlines for notification of changes in details;
- submit falsified goods in the ad (confirmed by a letter from the manufacturer and/or an official representative);
- do not adhere to the deadlines for placing an order;
- refuse to sign the contract on the terms specified in the proposal.

If a supplier commits 3 violations within a month or 5 violations within three months, their offers will be automatically hidden from the catalog for a period of 90 days.

3. How can a customer complain about a catalog supplier if the supplier has not fulfilled its obligations in good faith?

4. Can the customer suggest a supplier work in the catalog?

The catalog administrator – Centralized purchasing organization – independently verifies information in open registers about a potential supplier that has applied for qualification. No customer can influence its decision.

5. Does the state customer have the right to disqualify a participant from the catalog?

No, this option is not provided. Since all Prozorro Market suppliers have been selected for the catalog and have been qualified by the administrator, no customer can disqualify them.

6. What documents are required from the customer to declare the request procedure?

In order to publish the price proposals request, the buyer does not have to upload any documents to the system. They just need to fill in the electronic fields:

- product name;
- the volume of goods;
- the conditions of payment;
- the time of delivering;
- delivery address;
- deadline for submitting proposals (according to the rules, it is at least 2 working days).

7. Does the customer need to justify the choice of specifications and the expected cost?

There are no such requirements. The Resolution of the Cabinet of Ministers of Ukraine No. 1266 dated 16.12.2020 states that justifying the choice of specifications are necessary only in the case of competitive procurement. Purchasing through the catalog does not apply to this type of procedure.

8. How long does the request procedure take?

Given the prevailing practice, the request for quotations procedure usually lasts 8 calendar days. The minimum allowable period is 3 days. The duration depends entirely on the deadline for the submission of proposals set by the customer. In any case, I advise you to set a deadline of no more than 2 working days, since suppliers do not need to prepare any documents for participation – they only submit their price offer and confirm the specification.

9. Can I buy several different products within one purchase?

You can purchase several products in one basket using direct purchase through the catalog, but on condition that you do not buy products that cost more than UAH 50,000. At the same time, the total cost of all goods in the basket may exceed UAH 50,000. Read more in this article.

10. Is the customer entitled to cancel his purchase from Prozorro Market?

Until a purchase agreement has been concluded, the customer has the option to cancel the order or quotation request. He must disclose information about this through the SmartTender.biz within 1 business day from the date of such a decision.

11. What happens if the seller does not confirm the intention to conclude an agreement in the request for price quotations procedure?

If the winner of the request procedure refuses, the system selects the next participant as the winner. If the supplier's offer was the only one, the purchase is transferred to the "Bidding failed" status.

12. Is it possible to reject the winner's proposal in the request for price quotations?

When in the request for price quotations the status of the purchase is “Proposals reviewed”, the customer has the button “Cancel decision”. If you click it, the winner will be disqualified, but the procedure will automatically switch to the "Bidding failed" status.
