According to the amendments to the Law of Ukraine “On Public Procurement”, procurement participants have 24 hours to amend the submitted proposal at the qualification or prequalification stage.

How the customer notifies the procurement participant of any inconsistencies in the tender proposal

At the qualification or prequalification stage, the customer examines the tender proposal and, having found inconsistencies, notifies the supplier about them. Not later than 2 business days before the deadline for consideration of proposals, the organizer publishes a message with a request to correct the errors. Such a notice should contain the following information:

- list of inconsistencies;
- references to the clauses of the terms of the tender documentation, which are contradicted by the identified discrepancies;
- a list of documents and/or information that must be provided to eliminate the indicated inconsistencies.

The customer may publish such a message only once, except in cases concerning the implementation of the decision of the Antimonopoly Committee of Ukraine.

How is the procedure for correcting the conditions of the offer

Immediately after the customer has posted a message about inconsistencies in the tender documentation, a letter is sent to the supplier’s email address and personal account. This letter informs the participant that he can upload new or revised documents to the system within 24 hours from the date of publication public procurement system of a message about the presence of non-conformities.

Please note that errors can be corrected only in specific documents:

- confirming the compliance of the supplier with the qualification criteria listed in Art. 16 of the Law on Public Procurement;
- provided in support of the right to sign the proposal and/or the procurement contract.

After receiving the corrected documents, the customer re-examines the submitted proposal and makes the final decision.
